Amicus Curiae Brief in respect of the Case No. 922/4206/24

On 2 May 2025, the UAA Working Group submitted to the Commercial Court of Cassation of the Supreme Court a jointly prepared Amicus Curiae Brief in respect of the Case No. 922/4206/24.

This case raises an important issue as to validity and enforceability of arbitration agreements that refer disputes to ad hoc arbitration. The working group concluded that reference to an arbitral institution that will administer arbitral proceedings is not an indispensable element of an arbitration agreement, and that arbitration agreements that refer disputes to ad hoc arbitration should be recognized in Ukraine as valid, enforceable and capable of being performed.

 

The working group hopes that this brief and the academic and practical material it highlights will be of use to the Supreme Court.
